Douglas County Sheriff's deputies have made two arrests in the case of the intruder shot and killed by a homeowner.
They determined that William Fresch, 65, was justified in the Sunday killing of Joseph Daniel Boone, 42, because he was protecting himself under Colorado's so-called "Make My Day" law.
Deputies learned there was a second suspect at Fresch's house on Colorado 83 at the time of the apparent burglary.
Cheri Penn, 36, of Colorado Springs, left the scene in Boone's car, drove to Colorado Springs and met with Robert Garner, 53, deputies say.
Penn was arrested on Monday and charged with first-degree burglary, conspiracy and tampering with physical evidence. She is in jail because she isn't allowed to post bond due to a state parole violation.
Garner, who lives in Colorado Springs, was arrested for being an accessory to a crime, tampering with physical evidence and obstructing government operations. He posted a $3,000 bond and was released from jail late Tuesday.

This woman was there helping to facilitate this robbery. She is partly responsible for the home invasion and robbery.I was wondering why they picked that house. They attacked this family in their own home and then were surprised at it's outcome. These two people should be locked up so far in the prison they pipe in daylight. Also to all the other scumbags see what happens when your an idiot.Because you leave people no other alternative but to eliminate the problem. So when you see this understand many of us will use the same method to handle this problem. So if you want to rob, rape, and murder you might not survive the encounter with your chosen victim.I do not feel sorry for these people in any way shape or form.

That brave homeowner. He was smart and determined and I only hope that I can get to my gun as fast as he did if something like that happens to me.
Or my shotgun. Or my rifles. Or my other handguns.
